When to go to court, and free legal aid
Court is the last step, not the first. What it costs you to skip the record.
A writ petition is a real and often successful remedy in these cases. But going to court first, without a paper record, weakens a good case.
Why the record matters
A court reads a documented refusal very differently from a first approach. If you can show a written request to the branch, a grievance with a date, a 15-day deadline that passed, and a rejection with no reasons recorded, your petition is about a failure of the process. Without those papers, the answer will usually be to go and use the process first.
Build the record in this order
- Written request to the branch for the restriction details. Keep the stamped copy.
- Grievance submitted at the branch, with documents. Keep the acknowledgement and the reference number.
- If the branch stonewalls or closes it without reasons, a complaint against the bank on CPGRAMS at pgportal.gov.in, addressed to the Department of Financial Services. This is the step most people skip, and it is the one that produces a written answer.
- Review by the District Grievance Officer, and the State appeal where it applies.
- Only then, court.
If you cannot afford an advocate
Free legal aid is a statutory entitlement in India, provided through the National, State and District Legal Services Authorities. Approach your District Legal Services Authority, usually located in the district court complex. The SOP itself points to State and District Legal Services Authorities and Lok Adalat for restoration matters.

One situation where you should not self-file at all
If the disputed credit relates to a gaming, betting or gambling platform, take advice before you write anything. The questions there reach the source of the funds and your own position, not just the freeze, and a written representation made without advice is difficult to walk back.
